Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and MyHomeIQ, LLC("MyHomeIQ," "we," "us," or "our") governing your access to and use of the MyHomeIQ website at myhomeiq.io and any related services (collectively, the "Service").

By accessing or using the Service, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, please do not use the Service.

MyHomeIQ is an online platform that connects homeowners with licensed home improvement contractors for projects including but not limited to solar installation, roofing, HVAC, windows, electrical work, and remodeling. We also provide educational content such as cost guides, rebate information, and solar savings calculators.

We are a lead generation and referral platform — not a contractor. We do not perform home improvement work, employ contractors, or guarantee the quality, safety, or legality of any work performed by contractors found through our Service.

When you submit a quote request through our Service, you expressly consent to:

• Being contacted by up to three (3) licensed contractors in your area via phone, email, or text
• Receiving follow-up communications from MyHomeIQ including educational emails and promotional offers
• Having your project information shared with matched contractors for the purpose of preparing quotes

You may opt out of communications at any time by clicking "unsubscribe" in any email or contacting us at legal@myhomeiq.io.

Contractors who register on MyHomeIQ agree to the following additional terms:

• All information provided during registration must be accurate and current
• You hold a valid contractor license in all states where you accept leads
• You maintain general liability insurance of at least $1,000,000 per occurrence
• You will not resell, redistribute, or share leads received through our platform
• Subscription fees are non-refundable once a billing period has begun
• We may suspend or terminate accounts that receive excessive complaints

Contractor subscriptions are billed monthly or annually as selected at signup. All prices are in US dollars. Payments are processed securely by Stripe. By providing payment information, you authorize us to charge the applicable subscription fee on a recurring basis until cancelled.

You may cancel your subscription at any time from your billing dashboard. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that contractor information is accurate, complete, or up to date. We do not guarantee that you will receive quotes, that quotes will be competitive, or that any contractor will complete work to your satisfaction.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYHOMEIQ, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) one hundred dollars ($100).

You agree to defend, indemnify, and hold harmless MyHomeIQ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the effective date above and, where appropriate, by sending an email to registered users. Continued use of the Service after changes constitutes acceptance of the revised Terms.
